Welcome to Unified Voice. These Terms of Service (“Terms”, “Agreement”) govern your access to and use of the services, websites, and applications provided by Unified Voice Communication (“Unified Voice”, “we”, “us”, or “our”).
By accessing our website, signing up for an account, or using our services—including our VoIP platform, Unified Communications as a Service (UCaaS), IP PBX, Virtual Numbers, and enterprise messaging—you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Description of Services
Unified Voice provides cloud-based business communication services, including but not limited to Voice over Internet Protocol (VoIP) telephony, audio and video conferencing, SMS services, virtual receptionist capabilities, and call analytics (collectively, the “Services”). We reserve the right to modify, update, or discontinue any feature of the Services at any time with prior notice where reasonably possible.
2. Account Registration and Security
To use our Services, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your information to keep it accurate and secure.
- Maintain the confidentiality of your login credentials and SIP details.
- Be entirely responsible for all activities that occur under your account, including authorized and unauthorized use.
3. Acceptable Use Policy (AUP)
You agree to use the Services only for lawful business purposes. You must not use the Services to:
- Transmit illegal, harassing, defamatory, fraudulent, or abusive content.
- Engage in mass telemarketing, auto-dialing, robocalling, or SMS spamming without explicit consent from the recipients (strictly in accordance with TRAI’s NDNC/DND regulations).
- Falsify caller ID information (spoofing) or impersonate another business or individual.
- Attempt to bypass our security measures, probe our network vulnerabilities, or engage in any form of cyber-attack.
Violation of the AUP may result in immediate suspension or termination of your account without notice or refund.
4. Regulatory Compliance
As a telecom and cloud communications provider operating in India, Unified Voice complies with the guidelines set by the Department of Telecommunications (DoT) and the Telecom Regulatory Authority of India (TRAI).
- Toll Bypass: You agree not to use our network to bypass standard long-distance telecom toll charges (Interconnect bypass) where prohibited by Indian law.
- Telemarketing Compliance: If you are an enterprise using our bulk SMS or voice broadcasting services, you must be registered as a telemarketer if required by TRAI and strictly adhere to the Telecom Commercial Communications Customer Preference Regulations (TCCCPR).
Emergency Services Disclaimer
IMPORTANT: Our VoIP services are not a traditional telephone service.
You acknowledge and understand that the Services may not support traditional 100, 101, 102, 112, or other emergency dialing services in the same way as traditional landlines. Power outages, internet disruptions, or account suspensions will prevent you from making any calls, including emergency calls.
6. Billing, Payments, and Fair Usage Policy (FUP)
- Charges: You agree to pay all applicable charges associated with your chosen plan, including subscription fees, usage charges, and applicable taxes (such as GST).
- Prepaid/Postpaid Terms: Services are generally billed on a [prepaid/postpaid] basis. Failure to pay invoices on time may result in service suspension.
- Fair Usage Policy (FUP): “Unlimited” calling and messaging plans are subject to our Fair Usage Policy to prevent abuse and network congestion. We reserve the right to monitor usage and apply standard per-minute rates or suspend the account if usage heavily exceeds standard business patterns.
7. Intellectual Property
All software, designs, logos, text, and technical infrastructure powering the Services remain the exclusive intellectual property of Unified Voice. You are granted a limited, non-exclusive, non-transferable license to use the Services.
8. Data Privacy
We prioritize your privacy and the security of your communication. Our collection, use, and processing of your personal and business data, including call recordings and analytics, are governed by our Privacy Policy. By using the Services, you consent to our data practices.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Unified Voice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business goodwill arising from:
- Your use or inability to use the Services.
- Unauthorized access to your account or alteration of your communications.
- Any network downtime, internet outages, or hardware failures.
10. Service Level Agreement (SLA) & Warranties
While we strive to provide 99.9% uptime, the Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. We do not guarantee that the Services will be completely free from interruptions, latency, or errors.
11. Termination
You may terminate your account at any time by contacting our support team and paying any outstanding dues. Unified Voice may suspend or terminate your services at its sole discretion if you violate these Terms, fail to make payments, or engage in activities that harm our network or reputation.
12. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.
